Expression of Interest for private landowners of Captains Flat to deposit lead contaminated soil into the mine-site containment cell
Purpose
We are working with Legacy Mines (Resources NSW) to develop an estimate of the volume of lead contaminated soil from private land in Captains Flat for disposal in 2025-2026, weather permitting.
Council is inviting private landowners who wish to undertake development or remediation works on their property, which involves the removal of lead contaminated soil, to complete this Expression of Interest (EOI).
The results from the EOI will help support the development of a final design and capacity of the containment cell.
All results from the EOI will be de-identified and only quantities (volume) and details of soil quality will be provided to Legacy Mines to support the containment cell design process.
Who is this EOI for?
Private landowners in Captains Flat who are preparing to undertake development or remediation works on their property over 2025-2026 and will be required to remove lead contaminated soil as part of these works.
This can include building on vacant land, major renovations and extensions, landscaping and any other works requiring the removal of lead contaminated soil from private land.
When does this EOI close?
The EOI closes on Monday 9 December 2024.
What is the Mine-Site Containment Cell?
The NSW Government has reserved capacity in the containment cell for lead contaminated soil from the Captains Flat community and is working with Council to manage the process.
The containment cell involves treating mine site waste and encapsulating it in a purpose-built containment cell on the mine site before capping and revegetating the site.
It is planned that the containment cell will also receive lead contaminated soil material from other public land remediation projects within the Captains Flat precinct, including Foxlow Parklet, the Eastern Embankment and other public land parcels.
In the absence of any residents taking up the remaining capacity of the cell, Council intends to secure the remaining capacity for council owned/operated public land remediation.

What is required of private landowners wishing to deposit lead contaminated soil from their private land into the containment cell?
While private landowners are responsible for the remediation of private land, there is an opportunity to use the containment cell for the disposal of lead contaminated soil. We have opened the EOI process to estimate the volume of lead contaminated soil.
This opportunity will only be available while the containment cell is open for a limited 12-month period between mid-2025 – mid-2026. After this period, the containment cell is required by legislation to be closed and capped to complete the mine-site remediation.
While there won’t be a cost to dispose of lead contaminated soil from private land into the containment cell, landowners will be responsible for undertaking a development application if it is required for your proposal, a detailed site investigation, engaging technical experts as required, and the removal and transport costs associated with removing contaminated material.
Can the containment cell be re-opened?
No. The containment cell will not be reopened once it has been capped. It is a significant undertaking to reopen a containment cell once closed.
The disposal of lead contaminated soil from private land into the containment cell is a once-off opportunity.
The Development Application process
Development in Captains Flat requires a development application, whether this is for home extensions or renovations, or for new development.
Ancillary developments and minor works may be able to use the Standard Remediation Action Plan available on the NSW Resources website that was developed as part of the Lead Management Plan. More complex developments, such as new builds, are required to have a site-specific remediation action plan prepared by the appropriate professionals.

To dispose of contaminated material in the containment cell, a private landowner would need to make a development application or plan for remediation works in 2024 or early 2025 and secure consent for works to be undertaken in 2025 - mid-2026.
At the Council meeting held on 26 June 2024, Council approved the Terms of Reference for the Captains Flat Lead Management Network. The Network will continue the work of the Taskforce, with a community focus.
The Network will consider:
- Local tourism activation projects
- Captains Flat Community Plan
- Reports from NSW State Agencies on the progress or implementation of lead abatement activities and projects
- Community and private lands lead contamination matters including financial support for private land remediation and a viable disposal option
The Network will include:
- General Manager or delegate of QPRC (Chair)
- Senior representative from Department of Premier, NSW
- Senior representatives from QPRC
- Community Members representing the Captains Flat Progress Association, Captains Flat Lead Working Group, Molonglo Rail Trail and other community associations.
- Mogo Local Aboriginal Lands Council

Background
The Captains Flat Lead Management Taskforce was established in January 2021 in response to the detection of elevated lead levels in the disused rail corridor adjacent to the former Lake George mine.
The community were first advised of the contamination on 29 January 2021 and the first community information sessions were held on 8 and 9 February 2021.
The Taskforce comprised of representatives from 5 state agencies and a representative from the local council. Their remit was to:
- coordinate an inter-agency government approach
- deliver clear and consistent community messaging and engagement
- develop and deliver lead management projects based on assessment of risk
- coordinate cross-agency resources to ensure community awareness and support for living safely with lead.
The publication of the Lead Management Plan and subsequent community engagement in August 2023 marked the completion of the NSW Government Captains Flat Lead Management Taskforce purpose and role in the initial response to lead management in Captains Flat.
